New Increased, Paid Family and Domestic Violence Leave Entitlements

Last week, the Federal Government amended the Fair Work Act 2009. The Family and Domestic Violence Leave entitlement will increase from 5 days unpaid leave to 10 days paid leave in a 12-month period.  
 
These changes apply to all employees, including casuals. It will not be pro-rata for part-time or casual employees. 

The leave renews each year and does not accumulate year-to-year if unused.  

Transitional commencement dates 

  • For non-small business employers (15 or more employees): this entitlement will commence 1 February 2023 

  • For small business employers (less than 15 employees): this entitlement will commence 1 August 2023 

Employees will continue to have access to 5 days of unpaid family and domestic violence leave until they can access the new paid entitlement.
